Consumer Health Data Privacy Notice

This notice applies to residents of Washington State and Nevada, and describes how Figura Body handles "consumer health data" as those states' laws define it. It supplements our Privacy Policy.

Consumer health data we collect

• • Body measurements and details you enter: weight, height, age, biological sex, activity level and waist circumference
• • Your body fat percentage, whether estimated by our AI from your photos, calculated from your waist measurement, or entered by you
• • The front and side physique photos you choose to submit for AI body analysis (processed for the estimate and not stored by us)
• • Your fitness goal and the body areas you want to focus on
• • Workout, cardio, step and food logs you record
• • Step count and weight read from Apple Health, only if you connect it

Why we collect it

We use this data only to provide the App's features you ask for: estimating your body fat, calculating your calorie, protein and step targets, building your training plan, tracking your progress and running your Monthly Protocol Review. We do not use it for advertising and we never sell it.

Where we get it

From you directly, from Apple Health if you connect it, and from the body fat estimate our AI service provider produces from the photos you submit.

Who we share it with

We share consumer health data only with service providers that process it on our behalf, under contract, to run the App:

• • Supabase (stores your account and logs)
• • OpenAI (receives your photos and measurements to produce the body fat estimate; may keep them for up to 30 days to monitor for abuse)
• • Resend (delivers your data export to your own email address when you request one)

We do not sell consumer health data, and we do not share it with anyone for their own purposes.

Your rights

You can:

• • Confirm whether we hold your consumer health data and get a copy of it: in the App, go to Profile → Privacy & Security → "Request My Data", or email privacy@figurabody.com
• • Get a list of every third party and affiliate we have shared it with, and how to contact them: email privacy@figurabody.com
• • Delete it: in the App, go to Profile → Delete Account, or email privacy@figurabody.com
• • Withdraw your consent: email privacy@figurabody.com, or delete your account. We then stop collecting and processing your consumer health data, except where the law requires us to keep it.

We respond within 45 days. If we decline your request, you can appeal by replying to our answer with the word "Appeal"; we respond to appeals within 45 days. If we deny your appeal, you may contact the Washington State Attorney General (atg.wa.gov) or the Nevada Attorney General (ag.nv.gov).
